How to start an NGO?

Before starting an NGO you should be aware of the different issues that are affecting the society and your determination to find a solution to the problem.
Having a clear idea will help you formulate the purpose and mission of your NGO accordingly. Having a burning desire to help the needy and being prepared to strive hard for the humanitarian cause will help you in establishing the NGO.

Documents

You will need some necessary documents for starting an NGO

  • Memorandum and Rules & Regulations in Duplicate duly signed by Minimum Three persons (Each page on bottom).
  • Ownership Proof of Registered Office. (Electricity Bill/Sale Deed/ GPA/Water Bill etc.)
  • Residential/Office Address Proof of all members of the Society. Such as Voter ID/ Telephone Bill/ Electricity Bill/Passport/Driving License etc.
  • NOC from Owner of premises on Rs.10/- Stamp Paper.
  • An affidavit from President on Rs.10/- Stamp Paper.
  • A list of Desirous persons should be signed by all members of society.
  • Desirous persons or the persons subscribing the name to the Memorandum should not be (in any case) less than seven. If it is proposed to give All India character to the society there must be a minimum of eight different persons from different States of Indian Union to the Memorandum.

How to register an NGO?

You can register an NGO in India through any of these three Acts:

  • Society Act
  • Trust Act
  • Company Act

Society Act:

To register under the Society Act, you will require a Memorandum of Association and Rules and Regulations document. To create this important document a minimum of 7 members are required. In this Act, NGOs are registered as societies, but in the state of Maharashtra, NGOs can be registered as trustees.

Trust Act:

Different states of India have Trust Acts however if the state does not have a Trust Act then the 1882 Trust Act becomes applicable. At least two trustees are necessary under this Act. To register an NGO under the Trust Act, you will need a document called a deed. You will have to apply to the registrar or commissioner office.

Section 8 Company Act:

To register an NGO under the Company Act you will require Memorandum and Articles of Association and Regulation document. A minimum of three members is required to create this document.
